Bergen indictment charges 3 with raping Waldwick woman met at Teaneck bar

EXCLUSIVE: Three Morristown men were indicted by a Bergen County grand jury on charges of twice raping an intoxicated Waldwick woman they met in a bar in Teaneck.

The 24-year-old woman was treated at Hackensack University Medical Center after she contacted Waldwick police – who, in turn, alerted the Bergen County Prosecutor’s Office Special Victims Unit — following the June 2013 incident.

An investigation by the unit led to the arrests nearly three weeks later of Myron Damus (above, right), Emanuel Brice (above, left) and Franklin Simmons (middle).

All three were indicted on four first-degree charges of aggravated sexual assault “using physical force or coercion” and “knowing the victim was physically helpless, mentally defective or incapacitated.”

The indictment retunred Jan. 27 also charges them with a second-degree count of conspiring to commit sexual assault.

Brice was a public safety officer at Drew University, Bergen County Prosecutor John L. Molinelli said at the time.

Simmons, meanwhile, worked for a pet grooming service in Morristown, while Damus worked for a mutual fund and communications firm based in Bloomfield, the prosecutor said.

Damus was released on $75,000 bail — reduced from $250,000 — three days after the arrests.

Bail information on Brice and Simmons wasn’t available.
