YOU READ IT HERE FIRST: A man accused of making unwanted sexual advances to a Rockland County woman while he worked for a cable company was charged with committing the same crimes against two Bergen County women in their homes — one a 71-year-old from Fairview and the other a 60-year-old from Ridgefield Park.

Jonathan Malave, 31, was being held on $250,000 bail, charged with sexual assault and criminal sexual contact after being arrested at his Towaco home yesterday.

Malave, who is unemployed, was working as a service technician when he “engaged in inappropriate sexual activity” with the Ridgefield Park woman in her home in July 2014 and with the Fairview woman in her home a month later, Bergen County Prosecutor John L. Molinelli said this afternoon.

“The second victim recently contacted the Fairview Police Department and reported to them what had occurred,” Molinelli said.

They, in turn, contacted the Bergen County Prosecutor’s Office Special Victims Unit, and an investigator from that unit, along with a Fairview detective, interviewed her, he said.

She “described to them in greater detail what had occurred,” the prosecutor said.

Malave was arraigned earlier today in Hackensack.

Two years ago he was living in Belleville and working as a cable repair subcontractor when a 32-year-old Stony Point woman told police he sexually assaulted her on a call — first kissing and then reaching down and touching her.

YOU READ IT HERE FIRST: Edgewater police seized three bundles of heroin, medical marijuana and prescription pills, as well as nearly two dozen hypodermic needles, following a River Road traffic stop last night.

Officers James Dalton and Joseph Criscuolo stopped a Chevy Camaro for making an improper left onto Hudson Avenue around 8 p.m., Sgt. Steven Titus told CLIFFVIEW PILOT just after midnight.

They spotted the marijuana on the passenger seat, got consent to search the car from the driver — identified as 32-year-old New Milford native Justin Pearly — and found the other drugs, Titus said.

Pearly, of Nutley, was being taken to the Bergen County Jail, where a judge ordered him held on $25,000 bail.

Charges include drug distribution, possession of drugs with the intent to distribute them, possession within 500 feet of a public park and possession of drug paraphernalia. Police also issued him traffic summonses.

YOU READ IT HERE FIRST: A grand jury in Hackensack yesterday indicted a Megan’s Law offender originally from Lodi on charges of violating his parole by visiting social media sites.

CLIFFVIEW PILOT last year found profiles for 47-year-old Thaddeus Gil on a few social sites, including deviantART.com and YouTube. He was also listed as “available” on more than 50 others.

He primarily has used the screen name “Tgil3036,” but Bergen County Prosecutor John L. Molinelli said he also used “TGil” and “Thad Gi’l.”

Gil, who moved to Newark, remained free on $25,000, posted four days after his Oct. 21, 2013 arrest on initial charges stemming from his alleged online activity.

Records show that he was sentenced in Passaic County in January 2002 for sexually assaulting a 10-year-old girl. As part of his release, Gil, who found work as a driver for a Secaucus company, was to remain under community supervision for life and not use the Internet to access social media sites.

Gil was arrested following a joint investigation by members of the squad and the New Jersey State Parole Board Sex Offender Management Unit. The prosecutor also thanked Hillsdale police for providing personnel to the task force.

Indie film producer among victims of ID thieves caught by Fort Lee police

EXCLUSIVE: A former major independent film producer was among 14 victims whose credit card numbers were stolen by a crew of thieves — three of whom Fort Lee police said they arrested during a traffic stop near the George Washington Bridge — an indictment returned in Hackensack says.

The ring used the stolen credit card numbers to buy gift cards and iPhones, 43 of which were found after a Fort Lee detective stopped a rented 2014 Chrysler 300 this past March for speeding past him near the GWB lower-level tolls.

The iPhones alone were worth more than $27,000, police said at the time.

Fort Lee Detective Timothy Cullen also found 60 gift cards – all bearing the stolen numbers on their magnetic strips – that Police Chief Keith Bendul said were used to buy the iPhones at various malls in Pennsylvania.

The victims included the manager of a transportation firm, a medical device sales representative and the producer, who now does nonprofit fundraising, according to the indictment (NOTE: Because they are victims, CLIFFVIEW PILOT is withholding their names).

The cards were issued by, among others, Barclays Bank, Citibank, HSBC Capitol One and RBC Royal Bank, it says.

Charged in the indictment are Queens residents Joley Aristhee, 21, who remained free on $15,000 bail, Kianne Clarke, 24 (free on $10,000 bail) and 23-year-old Kristine Lewis (free on $5,000).

All three are charged with identity theft, credit card theft, forgery and receiving stolen property (the iPhones).

Aristhee is additionally charged with hindering apprehension.

Fairview grandson could have record cleared in burglary assault that killed World War II vet

$
0
0

A Fairview man who admitted targeting his 88-year-old grandfather for a burglary that led to the World War II veteran’s death at the hands of his accomplice won’t be going to prison — and can have his record cleared in three years.

Andrew Abella, 22, simply must remain out of trouble while meeting all the conditions of the Pre-trial Intervention Program and the entire matter “will go away,” Superior Court Judge Edward A. Jerejian told him yesterday.

For Abella to qualify, authorities first had to revoke a plea deal that he agreed to in December 2012 that could have sent him to jail for less than a year or brought him probation.

Assistant Bergen County Prosecutor Deepa Jacobs cited Abella’s assistance in obtaining a guilty verdict in the trial of co-defendant Edwin Estrada, 23, of Cliffside Park, who was sentenced last month to 60 years in state prison for beating Vincent Leuzzi with a cooking pot while looking for drug money for both of them during the bungled July 2010 burglary.

Leuzzi died of his injuries nine days after receiving what authorities said were eight to 12 blows to the head.

Estrada was arrested in New York City and originally charged in Hackensack with attempted murder and armed robbery. He made things easy for investigators by using Leuzzi’s credit card to buy clothing in Washington Heights, in a transaction captured on surveillance video.

The charges were upgraded to murder after Leuzzi’s death.

Estrada contended that he’d smoked PCP in Leuzzi’s bathroom, got paranoid and began hitting him with the pot while hearing “the devil” say “do it, do it” in his head.

A state psychiatric expert rejected that account.

Estrada originally pleaded guilty in March 2013 to aggravated manslaughter in exchange for a 27-year prison term. But Presiding Superior Judge Liliana DeAvila-Silebi nixed the deal and scheduled a trial after family members called for the death penalty.

Those same family members — who are also Abella’s — agreed to pre-trial intervention for him, said Jacobs, the assistant prosecutor.

Under PTI, Abella must submit to random drug and alcohol tests.

Jacobs warned him to “be aware” that his testimony in Estrada’s trial could be used against him if he gets in trouble again in the next 36 months.

Charges boosted in Garfield mother-son pot factory case

ONLY ON CVP: A grand jury in Hackensack has added a pair of marijuana distribution charges against a Garfield man already accused with his mother of first-degree manufacturing and possession.

Prosecutors offered Sandra and Mark Pelicot, both of Main Street, deals of six to 12 years following an earlier indictment on charges of operating a marijuana production facility, having more than five pounds of pot with the intent to distribute it; having more than an ounce with the same intent on the property of Three Saints Preschool and possession of $161,435 in cash that authorities want forfeited.

A new indictment returned Friday adds charges Mark Pelicot, 31, with distributing marijuana to a 30-year-old New Jersey University student twice on Three Saints property on May 29, 2013.

That man was ought on bail after Hudson County sheriff’s officer busted him for having two pounds of marijuana and $12,000 in alleged drug proceeds in his Jersey City apartment a year earlier.

Pelicot’s arrest violated probation for a 2011 burglary conviction. He was offered a 12-year sentence this time, with parole eligibility after six.

Prosecutors offered 49-year-old Sandra Pelicot a plea deal that would send her to state prison for six years, with parole eligibility after three.

Mark Pelicot remained free on $150,000 bail, posted two weeks after the arrests.

Sandra Pelicot posted $100,000 and was released a week earlier.

New Milford man who had ‘too much time on his hands’ gets 5 years for trafficking child porn

$
0
0

CVP EXCLUSIVE: A New Milford man whose attorney said had “too much time on his hands” was sentenced to five years in state prison after admitting he had hundreds of images of child pornography on his computer, dozens of which he shared.

Jackson Dietrich, 31, should be out in less than four years, having spent 362 days in the Bergen County Jail since his Nov. 26, 2013 arrest by members of the Bergen County Prosecutor’s Computer Crimes Task Force and New Milford police.

“I apologize for what I did,” he told Superior Court Judge Edward A. Jerejian on Friday. “Not a day goes by that I don’t regret it.

“I am ashamed for my family, and I ask for mercy,” said Dietrich, who lives with his parents and whose last job was as a busboy three years ago, according to defense attorney Joseph Rem.

Rem asked Jerejian to suspend parole supervision for life, a standard requirement for sex offenders.

Not to downplay the seriousness of child pornography and its distribution, Rem said, “but parole supervision for life is intended for offenders who commit crimes against actual victims.

“I understand that if fewer people looked at child pornography, maybe people would take fewer photos,” he told the judge. “He didn’t touch a child, he didn’t assault anyone.

“After his prison term he will be sitting at home. The authorities will be monitoring his computer.”

The judge, in turn, asked Assistant Bergen County Prosecutor Brian Sinclair about the type of images.

“They included acts of sexual penetration — vaginal penetration, anal penetration,” Sinclair responded.

The age range of the victims was broad, with the oldest victim about 16 years old, he told Jerejian.

The images numbered in the hundreds, at least 25 of which Dietrich shared, Sinclair said.

“[B]ecause of the quantity, we literally stopped counting,” he said.

Although parole supervision for life is at a judge’s discretion, “it is the best tool we have for monitoring ongoing illegal activity,” the assistant prosecutor said.

“While Megan’s law is a very valuable weapon in the arsenal, there are many people in Bergen County living near Megan’s Law offenders, and they have no idea because only the police have to be notified,” he said.

“The real way to monitor him is parole supervision for life,” Sinclair said. “That will limit his ability to ever harm a child. It will prevent him using the Internet without prior written approval.”

Jerejian rejected Rem’s request.

“There is no greater concern that could be expressed by this court than to prevent the sexual exploitation of children depicted in these photos,” he said. “Although I understand there was not a victim he had direct contact with, nevertheless, the children in those hundreds of photos are real victims.”
